OWE’s Cook Moderates INTA Panel on Using Copyright to Protect Logos

OWE’s Noel Cook was in Barcelona in May 2017 for the annual meeting of the International Trademark Association (INTA) where he moderated a panel, “Using Copyright to Protect and Enforce Rights in Logos,” featuring Richard Gilbey, GILBEY legal (France), Catherine Rowland, U.S. Copyright Office (United States), Joseph Simone, SIPS – Simone Intellectual Property Services Asia Ltd. (Hong Kong SAR, China), and Vivien Tsang, The Sherwin-Williams Company (United States).

In setting the stage for the panel, Noel, who is chair of INTA’s Copyright Committee Logos Subcommittee, noted that as source-identifiers, logos are protected by trademark law and as works of visual art, logos can also be protected by copyright law.  The panel provided the audience with the basics on copyright protection for logos around the world with special emphasis on the laws of the U.S., China and Europe (especially France) based on the expertise of the panelists.

In order to consolidate information on the protection of logos internationally, the Logos Subcommittee has developed a database of countries in Asia, Europe, Latin America, Middle East & Africa, and North America.  The database will help practitioners address basic questions on using copyright to protect logos in each country.  The committee plans to make the database available as a resource to INTA membership in the near future.  Contact Noel at ncook@owe.com for more information.
